Approach to patent prosecution

Technology first. Strategy throughout prosecution.

Effective patent prosecution starts with understanding what is technically significant about an invention and how that innovation should be protected over time. At Aylo IP Law, prosecution strategy is developed with both claim scope and long-term portfolio value in mind, with careful attention to the technical details that distinguish an invention from the prior art.

The process includes identifying potential examination challenges early, including prior-art issues, claim clarity, written-description and enablement concerns, and subject-matter eligibility issues. Claims and specifications are structured to support meaningful protection while preserving flexibility as examination progresses.

Throughout prosecution, the focus is on building a strong record, responding strategically to examiner positions, and maintaining alignment between the invention, the claims, and the client's broader objectives. The goal is not simply to obtain an issued patent, but to develop patent rights that are technically grounded, commercially relevant, and positioned to withstand future scrutiny.
